Sailo is committed to safeguarding your privacy and keeping you informed about the use of your personal information.
This Privacy Policy explains our information practices and describes how we collect, use, process, and disclose your information, including personal information, in connection with your access to and use of the Sailo website and mobile application. The Privacy Policy applies to your use of not only www.sailo.com but also to any other websites, features, applications, software, or services provided, owned, or administered by Sailo that link to this Privacy Policy, unless otherwise specified. When this policy mentions “Sailo,” “we,” “us,” or “our,” it refers to the Sailo company that is responsible for your information under this Privacy Policy (the “Data Controller”).
If there is any conflict or inconsistency between the Privacy Policy and the Terms of Use, the Privacy Policy will take precedence over the Terms of Use.
The updated Privacy Policy will automatically come into effect for all existing users on Apr 07, 2023. If you signed up for an account on or after Apr 07, 2023 the updated Privacy Policy will apply to you. Your continued use of the Sailo website and mobile application from that specific day on will be subject to the revised Privacy Policy, so please read it carefully.
Changes in the Privacy Policy
We reserve the right to modify this Privacy Policy, and we will notify you via our services or other means when we do so. If you do not agree with any changes, you may close your account. Your continued use of our Services after the publication or notification regarding changes to this Privacy Policy means that you approve of and consent to the updated Privacy Policy.
Information Automatically Collected
Information is automatically collected when you use our website or mobile application services. This helps us to run our services properly, comply with legal obligations, and improve the functionality of our website and mobile application.
Geo-location. We may collect your geo-location information to enhance your user experience while using certain features on our platform. You can enable or disable location services in your device settings, but please note that we may still collect this information by default if your device settings allow it.
Usage information. We also collect usage information about your interaction with our website and mobile application, such as the pages or content you view, your boat searches, bookings, and other actions.
Log data and device information. These are automatically collected when you access and use our website and mobile application, even if you don't have an account or didn't log in. This includes details about how you've used our website and mobile application, access date and time, hardware, software, and device information, device event information, unique identifiers, crash and cookies data, as well as the pages viewed before or after using our website and mobile application.
Collection and Use of IP Addresses. As part of our efforts to maintain the security and integrity of our platform, we collect and log the IP addresses of users upon login and during interactions with our services, such as during sign-up, email validation, and phone number verification. This data is collected for fraud prevention, detecting unauthorized access, combating spam, and addressing other security threats. We use this information strictly for the protection of our platform and users. The collection of IP addresses complies with applicable privacy laws, and we implement strong security measures to protect this data. We retain this information only as long as necessary for these purposes and may share it with third-party security providers or authorities when required by law.
Payment transaction information. We collect payment transaction information, such as the payment instrument used, date and time, payment amount, payment instrument expiration date and billing postcode, IBAN information, your address, and related transaction details. This information is necessary for the contract between you, us, and third-party payment services providers to run adequately.
Cookies and similar technologies. We also use cookies and other similar technologies such as web beacons, pixels, and mobile identifiers to operate and provide our services. We may allow our business partners to use these tracking technologies on our website and mobile application, or engage others to track your behavior on our behalf.
Information You Provide
We ask for and collect the following personal information about you when you use the Sailo website and/or mobile application. This information is necessary for the contract between you and us to run adequately, and also allows us to respect our legal obligations. Without it, we may not be able to provide you with all the requested services.
Account information. To use the Sailo website and app you will need to create an account with your first and last name, and email address.
Address Book Contact information. If you want to access certain features of our website, you may import your address book contacts or manually enter their information.
Profile and Boat Listing information. To book a boat or create a boat profile, you may need to provide additional information, such as your address, phone number, and profile picture.
Rental. If you rent or hire a boat, we may request and keep your credit card details or billing data. Additionally, we may gather more details from you, including your driving history, criminal records, loss history, and other relevant information for our underwriting procedure. In order to verify that you meet Sailo’s eligibility standards, we may also need you to approve our inspection of your driver record. By granting us permission to access your driver's record from state DMVs, RMVs, and other applicable entities, you allow them to release this information to Sailo.
Additional profile information. You may choose to provide additional, sensitive information in your Sailo profile, such as date of birth, language(s) spoken, and a personal description. Some of the information provided is part of your public profile and will be visible to others.
Communication with Sailo and other members. When you communicate with Sailo or other members, Sailo will collect information about your communication and any information you choose to provide.
Identity Verification Information. We may ask for identity verification information, such as government-issued ID, passport, national ID card, driving license, or other authentication information, as well as other authentication information such as your date of birth, current address, email address, phone number, and other details.
Payment information. To process payments for booking a boat or creating a boat profile, you may be required to provide financial information, like your bank account or credit card information. This facilitates the processing of payments via our 3rd party payment processors and is also legally required.
Mobile. If you download or use the Sailo app, we may obtain data about your mobile device and location, including a distinct identifier for your device. We may use this information to provide location-based services, like personalized content, search results, and advertising. The majority of mobile devices allow you to disable location services.
SMS Messages. To receive SMS notifications, meaning a list of text messages sent by the platform in response to system events or users' actions, you can add your phone number to your Sailo profile. By agreeing to receive SMS messages, you are authorizing Sailo to send mobile messages to the phone number you provided. It's important to note that your phone must be capable of receiving text messages for this service to work, and that standard message and data rates may apply. The frequency of messages may also vary. You can find more details about the SMS notifications here and in our Terms of Service. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
Reviews. When you write a review on our platform, it becomes publicly visible to members, visitors, and other users. Your name and picture, if you have provided one, will also be displayed alongside your review. Please note that once you share information publicly on our platform, it may remain visible even after you close your account or delete the information from your profile or inbox. To avoid any unwanted exposure, we recommend that you carefully choose what information and content you wish to disclose on areas of the platform that are accessible to the general public. Additionally, reviews associated with closed accounts will be attributed to an unknown user. Your profile may still appear in third-party services, such as search engine results, until those services refresh their cache.
Boat Hardware. If the boat you're renting or chartering contains a GPS tracking device enabled by its owners, they may have visibility into the boat's location throughout the rental or charter time. If there's a need to investigate claims, provide assistance, or satisfy legal requirements or processes, your location information might be shared with insurance companies, law enforcement, or other similar parties.
Other information. You may also provide us with information through various other means, such as filling out forms, searching for information on the website or app, updating your Sailo account, taking surveys, participating in promotions, posting on community forums, or using other features of our website and/or mobile application.
Customer Support. You can provide us with information related to your use of our website or application, including copies of your messages and contact details, in order for us to provide customer support.
Third-Party Information
We may collect your personal data and other information from various sources, including third-party providers who may gather data about you through our website and/or mobile application. If you have concerns about the disclosure of your personal information, you should contact them directly, as we are not responsible for how your personal data is processed by third-party providers.
Third-party services. When you link, connect, or log in to your Sailo account with a third-party service such as Google or Facebook, that service may provide us with information about you, such as your registration and profile details. The type and amount of information we receive varies, and is subject to the control of the third-party service or authorized by you through your privacy settings on that service.
Other sources. We may receive additional data about you from third-party partners and service providers, including demographic and fraud detection information, which we may combine with the data we already have. This is done in accordance with applicable law, and may include background check outcomes with your consent, or alerts about fraudulent behavior from service providers that offer identity verification services. Sailo may also receive information about your activities both on and off the Sailo website and/or mobile app, or details about your interactions and experiences from our partner ad networks through our partnerships.
How We Use Your Information
We use your personal information to improve, maintain, customize, and develop our website, mobile application, and services. This includes conducting research, providing customer service, sending messages, processing contact information for authorized purposes and fraud prevention, and personalizing user experiences based on their interactions with the website and mobile app.
We use your personal information to create and maintain a safer environment. This involves detecting and preventing fraud, spam, abuse, and other harmful activity, conducting security investigations and risk assessments, verifying information you provide, conducting checks against databases and information sources, and enforcing its terms of service and other policies. We may also conduct profiling based on your interactions with the website and mobile application, and automated processes may identify risky behavior that could lead to restricted access.
We use your personal information to improve our advertising and marketing services. This includes sending you promotional messages and advertising based on your preferences, conducting referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities, and profiling your characteristics and preferences to send you marketing that we think you might be interested in. This advertising may be sent via email or through social media platforms such as Facebook, Google, Twitter, Instagram, and LinkedIn. If you don't want to receive marketing materials or communications, you can change your notification settings in your Sailo account or follow the unsubscribe instructions provided in our communications.
We use your personal information to process financial data. This is done for various purposes such as detecting and preventing fraud, conducting security investigations, and complying with legal obligations. We also conduct checks against databases and other sources to ensure payment terms and policies are enforced and to enable payments to be made via our website and/or mobile application.
Information Sharing and Disclosure
Third-party Partners and Integrations. Our website and mobile application may have links to other websites or services which are not owned or controlled by Sailo. These links could be to third-party integrations, co-branded services, or third-party branded services called "Third-Party Partners." When interacting with these Third-Party Partners, you may be sharing information with them, with Sailo, or both. Third-Party Partners have their own policies regarding how they collect, use, and share information. We recommend that you read and review their privacy policies to understand their practices. Similarly, as part of our promotional efforts, we may display specific portions of our website and mobile application, such as your Boat Page, on websites operated by our business partners, using tools such as APIs or widgets. Keep in mind that if your Boat Page is displayed on one of our partner's websites, some details from your public profile page may also be visible.
Third-party Service Providers. We use third-party service providers to help with payment processing, verifying identity, fraud prevention, product development, and customer service. These providers may be located within or outside the European Economic Area. They have limited access to user information and must use it only for the purposes it was shared. We share user information with these providers to fulfill our contractual obligations. Please keep in mind that the providers are bound by Sailo's Privacy Policy to use the information only for authorized purposes. We will share your information, including personal information, with third parties with your consent. Data obtained through our SMS notifications, which are text messages sent by the platform in response to system events or users actions, will not be shared with any third-parties for their marketing reasons/purposes.
Third-party Search Engines. Any information you share publicly on our website and mobile application may be indexed by third-party search engines. In some cases, you have the option to opt out of this feature in your Account settings. However, if you modify your settings or your public-facing content, these search engines may not update their records immediately. We do not have any control over the methods utilized by third-party search engines, and they may store outdated data in their caches.
Listings. To help facilitate bookings and interaction, and for the contract between you and us to run adequately, we may need to share certain information with other members of the platform, including your personal information. When submitting a booking request as a Renter, the Boat Owner will receive certain personal information, including your full name and any other details that you have authorized to be shared. Upon confirmation of your booking, further information, such as your phone number, may be disclosed to help in organizing your trip. In addition, once you, as a Boat Owner, have a booking that has been confirmed, specific details will be shared with the Renter to facilitate the booking, including your complete name, phone number, and the locations for pick-up and drop-off. Boat listings on the website and mobile application are publicly visible and contain information such as location, profile photo, and aggregated information like Response Rate and Response Time. Furthermore, after a booking is completed, Renters and Boat Owners can write reviews and rate each other. These reviews and ratings are part of a user's public profile and may be displayed on the Boat Page or other parts of the Sailo website and mobile application.
Legal Compliance and Enforcement. Our website and mobile application may share your personal information with courts, law enforcement, government authorities, or authorized third parties in certain circumstances. This may be necessary to fulfill legal obligations, respond to legal claims, comply with legal proceedings, safeguard Sailo's interests, carry out agreements with users, or protect Sailo, our employees, or our users. If appropriate, we may inform users about legal requests, unless it is prohibited by law or would be ineffective or risky to do so.
Social Media Platforms. Where legally allowed, we may use some of your personal information, such as your email address, to generate leads, promote our products and services, or advertise Sailo on social media platforms like Facebook or Google. We do this to market our products and services to you. We share your personal data with social media platforms that aren't under Sailo's control or supervision, so if you have any questions about how they process your data, you should contact them directly. You can opt out of this type of processing for direct marketing by sending an email to support@sailo.com at any time.
Aggregated data. We may share aggregated and anonymous information for regulatory compliance, industry and market analysis, demographic profiling, marketing, and other business purposes. This information doesn't refer to any specific user and is created by combining data from multiple users.
Data and Your Rights
If you wish to make a request regarding your rights described in this section, send an email to support@sailo.com. We may ask you to verify your identity before proceeding with your request.
Data Retention and Account Erasure. We will keep your personal information for as long as it's needed to fulfill the obligations under the agreement and comply with laws. If you decide to close your account, some of your information may still be kept by Sailo for business reasons, such as for safety, fraud prevention, or to comply with legal and tax obligations. Additionally, any information that you have shared with others on Sailo, such as comments and reviews, may remain visible on the site after you close your account. However, your identity will be removed from such information. We also keep backup copies of the website and mobile application, which may contain residual copies of your personal information for a limited time.
Managing your information. You may access and update some of your information through your Account Settings. In the event that you have linked your Sailo account to a third-party application, such as Google or Facebook, you can modify your preferences and remove the app's access to your information by going to your Account Settings. It is your responsibility to ensure that your personal information is up-to-date.
Rectification of inaccurate or incomplete information. You have the right to ask us to adjust inaccurate or incomplete personal information that concerns you, provided you cannot update it yourself within your Sailo account.
Data access and portability. In some jurisdictions, applicable law may allow you to ask for copies of your personal information that we have. Subsequently, you may also have the right to ask for copies of personal information that you gave us in a structured, commonly used, and machine-readable format, if and where technically possible.
Withdrawing consent and restriction of processing. If you have given us your consent to process your personal information, you have the right to withdraw your consent at any time. You can do so by changing your Account Settings or by contacting us and letting us know which consent you wish to withdraw. Please note that withdrawing your consent does not affect the legal character of any processing activities that happened before you withdrew your consent.
In addition, in some jurisdictions, applicable law may give you the right to limit how we use your personal information. This applies when you contest the accuracy of your information when the processing is illegal and you oppose the erasure of your personal information when we no longer need your information for processing reasons but you require it for legal reasons, or when you have objected to the processing and the question of whether Sailo's legitimate reasons for processing override your own is still being determined.
Objection to processing. In some jurisdictions, applicable law may allow you to ask us not to process your personal information for specific purposes, such as profiling if the processing of your information is based on legitimate interest. If you do so, we will stop processing your personal information for these purposes, unless we can demonstrate there are strong legal reasons for processing your data, or if the processing is necessary for legal claims.If your personal information is being used for direct marketing purposes, you may request that we stop this by emailing us at support@sailo.com at any time.
Filing Complaints. You have the right to file complaints with the appropriate data protection authorities regarding the way we process your personal information.
Security
We are continuously implementing and updating administrative, technical, and physical security measures to help protect your information against unauthorized access, loss, destruction, or alteration. Some of the safeguards we use to protect your information are firewalls and data encryption, and information access controls.
We do not store credit card data and we use end-to-end encryption for all pages served, so all information is encrypted and transmitted to us in a secure way. Sensitive payment information is stored on secure servers by Stripe and Mangopay, our payment service providers. Although we utilize encryption to safeguard sensitive data transmitted online, we also take steps to secure your information offline: only authorized personnel is given access to personally identifiable information, in order to perform billing or customer service duties. The computers and/or servers where we store this information are localized in a safe and secure setting.
While we take steps to safeguard your personal information, it's important to note that no security system can be absolutely secure. Therefore, we can't guarantee that your information will always remain secure and protected from unauthorized access, alteration, disclosure, or destruction. By using our services, you accept the risk involved in transmitting your information to us. If you know or have reason to believe that your Sailo account credentials have been lost, stolen, misappropriated, or otherwise compromised, or in case of any actual or suspected unauthorized use of your Sailo account, please contact us immediately at support@sailo.com.

We use cookies and similar technologies such as web beacons, pixels, mobile identifiers, and tracking URLs, in order to provide, protect, and improve our website, mobile application and services, and to obtain Log Data, as described earlier in this Privacy Policy. These technologies help us understand how you interact with our site, improve its performance, and deliver tailored advertising and content to you. We also use these technologies to comply with regulations, detect and prevent fraud, conduct research, and help with our customer support, analytics, research, and product development.

In that case, the advertising content will just not be tailored to your interests. Also, we do not control any of these opt-out links and are not responsible for the availability or accuracy of these mechanisms.
Third-Party Social Plugins
The Sailo website and mobile application may use social plugins provided and operated by third parties, such as Facebook’s Like Button. As a result of this, you may send to the third party the information that you are viewing on a certain part of Sailo website and mobile application. If you are not logged into your account with the third party, then the third party may not know your identity. If you are logged in to your account with the third party, then the third party may be able to link information or actions about your interactions with Sailo website and mobile application to your account with them. Please refer to the third party’s privacy policies to learn more about its data practices.
Business Transfers
If we become involved in a merger, acquisition, bankruptcy, or other similar events, we may transfer, sell or share some or all of our assets, which may include your information. We may do this to facilitate the transaction, such as during the due diligence phase. We will notify you before transferring your personal information and changing the privacy policy.
Communication Analysis
We may monitor and analyze the messages and communications you send on our website and mobile application to detect and prevent fraud, assess risks, comply with regulations, improve our products and services, and provide customer support. Do Not Track
Our website and mobile application currently do not respond to a “Do Not Track” signal in the HTTP header from your browser or mobile application. This is due to a lack of standardization regarding how this precise signal should be interpreted.
Children’s Privacy
IF YOU ARE UNDER 16 YEARS OF AGE, PLEASE DO NOT USE OR ACCESS THE SERVICES AT ANY TIME OR IN ANY MANNER.
We make sure to avoid collecting or requesting personal information from individuals under the age of 16. If it comes to our attention that we have accidentally collected information from a child under 16 years old, we will remove that information immediately. California Privacy Rights
If you are a California resident, you may request a list of third parties to whom we have disclosed your personal information for direct marketing purposes during the previous calendar year, as well as the type of personal information that has been disclosed. You can make this request once a year free of charge by contacting us at support@sailo.com, and you must provide a current California address and confirm that you are a California resident. We will respond within 30 days of receiving your request.
International Users and Data Transfers
If you're using Sailo from outside the United States, please note that your information will be stored in the United States because our data centers are hosted there. If you're accessing Sailo from a region with different data collection, use, and disclosure laws than the United States, you should be aware that by using our services, you're agreeing to transfer your information to the United States. Your use of our services is governed by United States laws, our terms of service, and this Privacy Policy.
